Legal experts have cleared up the confusion over the treatment of employees who are absent
because of snow.
If the workplace is open businesses are under no obligation to pay staff who are unable to travel to
work in the snow.
Employees have a duty to attend the workplace unless they are sick, on annual leave or have some other authorised absence. Consequently, the employer can have the right to deduct pay for the days the employee is absent.
However, lawyers recommend that employers consider allowing employees to work from home or to take the day off as holiday. Other options include reaching an understanding that the employee will make up the lost time or take the time off as emergency dependant’s leave if schools close and they are required to look after their children.
